These Terms and Conditions (“Terms”) are an agreement between you and Beyond Engaged LLC, doing business as Killer Dealer Sites (“Killer Dealer Sites,” “we,” “us,” or “our”). They cover your use of killerdealersites.com (the “Site”) and the dealership website, CRM, AI, and other services we provide (the “Services”).
By using the Site, placing an order, paying a deposit, or using the Services, you agree to these Terms. If you are agreeing for a dealership or other business, you confirm that you have authority to bind it, and “you” means that business.
The Services
Our Services include:
- A custom website for your dealership, built and managed by our team in Dealer-OS, our website platform
- Hosting and SSL
- Built-in inventory and DMS sync
- Lead delivery to you by ADF or email
- Any add-ons you choose, such as the Website AI Chatbot, Ad & Listing Feeds, and the 24/7 AI Agent + CRM, as described on the Site and in your order
Some features depend on services run by others, such as your DMS or inventory provider, GoHighLevel, ad platforms, and listing sites, and work only while those services make them available. We may update and improve the Services over time.
Orders and Deposit
To start your website, you place an order and pay the deposit shown on your order. Like all our fees, the deposit is non-refundable (see Fees, Billing, and Refunds), including if you cancel before your website launches.
Fees, Billing, and Refunds
- Your monthly fee for your plan and any add-ons starts after onboarding.
- Fees are billed monthly in advance to your payment method on file, and you authorize us to charge it each month until you cancel.
- Prices are shown in U.S. dollars and do not include taxes, which you are responsible for where they apply.
- We may change our prices. We will give you at least 30 days’ notice by email before a new price applies to your plan.
- If a payment fails and is not resolved after we notify you, we may suspend the Services until your account is paid.
- Third-party costs are separate. Usage in your GoHighLevel account, such as texts, calls, AI minutes, phone numbers, and texting registration and carrier fees, is charged to that account’s wallet. Ad spend, and any fees your DMS, inventory provider, or listing sites charge for feeds, are billed to you directly by those companies.
- All fees are non-refundable, including the deposit, monthly fees, and add-on fees, except where the law requires a refund.
Cancellation
There is no long-term contract. You can cancel your monthly plan, or any add-on, at any time by emailing us at info@beyondengaged.com. Your service continues through the end of the billing period you have already paid for. We do not give refunds or credits for partial months.
We may end or suspend the Services if you materially break these Terms, including by not paying, and do not fix it after we notify you.
Building and Launching Your Site
We send you a preview of your website first. You approve it, and then we launch. Launch timelines are estimates, and they depend on you giving us the content, approvals, and access we need, such as your logo, photos, inventory feed, and domain settings.
Changes to Your Site
Our team makes all changes to your website in Dealer-OS. Send us your change requests. Reasonable content updates, such as text, photos, and specials, are included in your monthly fee, and your inventory updates on its own through your feed. Larger projects, such as a redesign, are quoted separately.
Your CRM Account
If you use the 24/7 AI Agent + CRM, you get your own GoHighLevel account (a sub-account) with your own login. GoHighLevel’s own terms also apply to it.
- You are responsible for the users you add to the account and what they do in it.
- Usage in the account is charged to its wallet (see Fees, Billing, and Refunds).
- Texting registration: carriers require businesses that text to register (A2P 10DLC). We register your business using the details you give us, such as your legal business name, EIN, and address, and you confirm they are accurate. Carriers decide whether to approve it, and texting may be limited or unavailable until they do.
- Phone numbers: you can port your account’s phone number to another provider when you leave (see When Your Service Ends).
Your Responsibilities
- Give us accurate content and information, and keep your logins secure.
- You must have the rights to the content you give us, such as photos, logos, and text.
- You are responsible for what your website says about your vehicles, prices, financing, and dealership, including disclosures required by the laws and rules that apply to auto dealers.
- Your website’s privacy policy and terms describe your dealership’s practices. Review them, and tell us when something about your business changes.
- You are responsible for getting any consent required from shoppers whose information your website, forms, CRM, and AI tools collect, and for handling the shopper information you receive, including credit applications, as the laws that apply to you require, such as the FTC Safeguards Rule.
- You are responsible for the calls, texts, and emails sent from your CRM account, including following the laws and carrier rules that apply to them (such as the Telephone Consumer Protection Act and CAN-SPAM), getting any required consent, and honoring opt-outs.
Acceptable Use
You agree not to use the Site or the Services to:
- Break any law or regulation, or violate anyone’s rights
- Post content that is false or misleading, infringing, or harmful
- Send spam or unwanted calls or texts
- Upload viruses or other harmful code, or try to get unauthorized access to our systems
- Interfere with the Site or the Services, or with other clients’ use of them
AI Features
Our AI search and Website AI Chatbot use AI models from Anthropic, and the 24/7 AI agent runs on GoHighLevel. AI answers are generated automatically and can be incomplete or wrong. They are not binding offers, price quotes, or credit decisions unless you or your staff confirm them.
The AI agent records and transcribes calls. You are responsible for reviewing how your AI tools are set up and the information they draw from, such as your inventory, prices, and hours. You are also responsible for following the laws that apply to automated calls, texts, call recording, and AI, including giving any required notice that a call is recorded or that the caller is speaking with AI, and getting any consent required before your AI agent calls or texts someone.
Ad & Listing Feeds
With Ad & Listing Feeds, we send your vehicle inventory to ad platforms and listing sites, such as Meta and TikTok. Those platforms’ own rules and ad policies apply, they decide whether to accept or show your listings, and you pay any ad spend directly to them.
Text Messages
Killer Dealer Sites sends text messages to people who agree to receive them:
- Service messages about your order, onboarding, and support, and reminders for calls you book
- Marketing messages about our offers and services, only if you check the separate box agreeing to marketing texts
You agree by checking the text message box on our forms. The boxes are never checked for you, and agreeing is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help, or contact us at info@beyondengaged.com or (915) 701-5613. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information; we do not share your mobile number or text messaging consent with third parties for marketing.
Ownership
Yours: your domain name, which you register and own, and the content you provide, including your logos, photos, text, inventory data, and leads. You allow us to host, copy, display, and adapt that content as needed to provide the Services.
Ours: the Site, the Killer Dealer Sites name and logo, Dealer-OS, and the code, designs, templates, software, and tools we use to build and run websites, including your website’s code and design. While your plan is active, you have the right to use your website as part of the Services.
Portfolio: we may show your website in our portfolio and marketing, unless you tell us in writing not to.
When Your Service Ends
Your website comes down at the end of your last paid billing period. Within 60 days after that, you can ask us to:
- Send you copies of the content you provided us
- Send you an export of your CRM account’s contacts and conversations, if you use our CRM
- Help you port your CRM account’s phone number to another provider
- Help you point your domain to your new provider
After those 60 days, we close your CRM account, and its data, including conversations and call recordings, may be deleted.
Accessibility
We build websites with accessibility in mind and work toward recognized standards, such as the Web Content Accessibility Guidelines (WCAG). We do not guarantee that your website meets any particular accessibility standard or law. You are responsible for the accessibility of the content you provide, such as photos, documents, and videos. Tell us about any accessibility issue so we can work on it.
Security
We use reasonable safeguards to protect the information we handle for you. If we learn that your shoppers’ information in our systems, or in our providers’ systems, has been accessed without permission, we will notify you promptly and work with you to respond.
Third-Party Services
The Services connect with services run by others, such as DMS and inventory providers, GoHighLevel, Anthropic, Google, Meta, TikTok, listing sites, and payment processors. Their own terms apply to your use of them, and we are not responsible for their outages, changes, or actions.
No Guarantees
We work to keep your website fast, secure, and available, but we do not guarantee that the Site or the Services will be uninterrupted or error-free. We do not guarantee any particular search ranking, traffic, number of leads, or sales, or that carriers will approve your texting registration.
Except as stated in these Terms, the Site and the Services are provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows.
Limitation of Liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, even if we were told they were possible.
- Our total liability for all claims related to the Site or the Services is limited to $100.
Indemnification
You agree to defend and hold harmless Killer Dealer Sites and its owners and team from claims, losses, and costs (including reasonable attorneys’ fees) that arise from your content, your vehicle listings and advertising, the calls, texts, and emails sent from your CRM account or by your AI tools, or your breaking these Terms or the law.
Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. If a dispute comes up, contact us first, and we will try to resolve it informally. Any lawsuit must be brought in the state or federal courts located in El Paso County, Texas, and you and we agree to those courts’ jurisdiction.
Changes to These Terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. If the changes significantly affect your paid Services, we will give you notice by email before they apply. Continuing to use the Site or the Services after changes take effect means you accept them.
General
These Terms, together with your order, are the entire agreement between you and us about the Services. If any part of these Terms cannot be enforced, the rest stays in effect. If we do not enforce a part of these Terms, we have not waived it. You may not transfer these Terms without our written consent. We are not responsible for delays caused by events beyond our reasonable control.
